Council Function

The status of the council

  1. 1. The Status of the Council as an Organization Representing the Residents: The council has a status as an organization representing the residents and deliberating the major tasks of the local autonomous agencies.
  2. 2. The Status of the Council as a Body in Charge of Voting Procedure: As a body in charge of voting procedure, the council has the function of finally deciding the opinions of the local autonomous agencies over the major tasks.
  3. 3. The Status of the Council as a Legislative Body: The council has a status as a legislative body that enacts the ordinances.
  4. 4.The Status of the Council as an Audit Office: The provincial council has a status as a audit office that does surveillance on whether or not the executive agencies are carrying out the administrative work lawfully and rationally.

The Rights of the Council

  • Voting rights
    • Voting rights are one of the most important functions of the provincial council. The important matters for voting procedure are as follows.
    • - Enactment, revision, and the scrapping of the ordinances
    • - Deliberations and the decisions of the budgets; settlement of accounts
    • - Usage fees, commissions, allotted charges, provincial taxes and imposition and collection of admission fees, except those regulated by law
    • - Settlement and the operation of funds; acquisitions and the disposals of the major assets regulated by the Presidential decrees; and the establishment and the disposal of the public facilities
    • - Imposition of duties and the renouncement of rights except the matters defined by the laws and ordinances
    • - Acceptance and the disposal of petitions
    • - The matters for decision through votes, which are defined in other related laws or bills
  • Audit and Inspection of Administrative Work
    • The local council is authorized to carry out audit and inspection over the administrative work of the local autonomous agencies or to investigate special issues through the vote of the local council.
    • When necessary, the local council can check the location and request the submission of the related documents, the attendance of the chiefs or the subsidiary organs of the local autonomous agencies, as well as their testimonies or statements.
  • Rights to Deal with Petitions
    • The local council is authorized to deal with the petitions from the residents through the introduction of more than one member.
    • A petition is a document signed by regional citizens which asks the local council to do a particular thing, including rectification or enhancement over the issue of their complaints or wishes. The petitions cannot be dealt with in the following cases: when they interrupt the process of trials, or when they violate the laws.
  • Rights for Autonomy

    The council will not be interrupted by the other organizations (state agencies, executive bodies) with regard to organization and operation.

  • Rights for Voting

    The council has the right to vote over the members of the inner organizations (chairman, vice-chairman, standing committee chairman, special committee chairman), and the right for selection and recommendation for the outer organizations (selection of the members who are screening the settlement of accounts, and the recommendation for
